Who these terms are between

These terms apply between you and the business operating poaindubai.ae, referred to below as we, us and our. They cover your use of this website and any work you instruct us to carry out. By using the site or instructing us, you accept them.

What this website is

This site explains how powers of attorney are prepared, ratified and attested in the United Arab Emirates. It is written to be accurate and it is kept up to date, but it describes the general position. It is not advice on your matter. Your document depends on what you need it to allow and on what the office receiving it requires, and neither of those can be answered by a web page.

What we do

We prepare the document and take it through the steps that make it usable. In practice that means:

• drafting the deed in Arabic, in wording that matches what you need the agent to be able to do
• providing legal translation where a second language is needed
• checking your identity documents and supporting papers before anything is submitted
• booking the appointment and attending with you, or acting on your behalf where the process allows it
• handling attestation after ratification where your matter needs it

What our service does not cover

We also do not control what any other authority decides. A receiving office, court, bank, registry or consulate sets its own requirements and may change them without notice. We will tell you what those requirements appear to be and we will draft to meet them, but we cannot promise that a third party will accept a document.

No authority in the United Arab Emirates issues an apostille, because the UAE is not a contracting party to the 1961 Hague Convention. If a checklist you have been sent asks for one, we will tell you so plainly. We cannot obtain something that does not exist.

Government fees and charges

Fees charged by a government authority are set by that authority, collected by it, and can change at any time. They are separate from anything we charge for our own work. Where we pay a government fee on your behalf, we pass it on at cost and we will tell you what it was before we pay it.

What we need from you

So that the work is correct, you agree that:

• the information you give us is true and complete
• the identity documents you provide are yours, valid and not altered
• you have the authority to give the instruction, including where you are acting for a company
• you will tell us promptly if anything changes, including if you decide to revoke a power of attorney we prepared

If information turns out to be wrong or missing, the work may have to be redone, and any government fee already paid on the first attempt is not recoverable by us.

Timescales

How long a matter takes depends on the authority involved, on appointment availability and on how quickly documents reach us. We will give you a realistic expectation at the start and tell you if it changes. We do not guarantee a completion date, because the parts that take the longest are not ours to control.

Our fees and payment

What our own work costs depends on what the matter needs, so we quote it for your matter before we start. The quote tells you what is included, what is a government fee, and what is not included. Nothing on this website is a quotation and nothing here is an offer to contract at a stated price.

Cancelling an instruction

You can tell us to stop at any time, in writing, to the email address below. If you cancel before we have started drafting, there will normally be nothing to pay for our work. If drafting or translation has begun, we will tell you what is due for the work already done. A fee already paid to a government authority on your behalf is not something we can refund, because we no longer hold it.

If something goes wrong

Tell us. Email the address below with your name, the matter and what has happened, and we will look into it and come back to you. Most problems in this field are a wording problem or a missing document, and both are usually fixable.

Limits on our responsibility

We take care over the work we do and we are responsible for our own mistakes. We are not responsible for loss caused by something outside our control, including a change in the law or in an authority’s requirements, a decision by a notary, court, registry or consulate, a delay by a government office or a courier, or information you gave us that was wrong or incomplete.

Nothing in these terms limits any liability that cannot be limited under the law of the United Arab Emirates.

The content of this website

The text, layout, images and structure of this site belong to us. You may read it, print it and quote from it with attribution. You may not copy it wholesale to republish as your own, and you may not scrape it to generate a competing site.

Links to other websites

Where we link to a government authority or another organisation, we do it because the source is useful. We do not control those sites and we are not responsible for their content or for what they do with your information.

Changes to these terms

We may update these terms. The date at the top tells you when they last changed. The version in force for your matter is the one published when you gave us the instruction.

Governing law and jurisdiction

These terms are governed by the law of the United Arab Emirates as applied in the Emirate of Dubai, and the courts of Dubai have jurisdiction over any dispute arising from them.
