A power of attorney, and what Ajman changes about it

A power of attorney is a contract. One person, the principal, appoints another, the agent, to act in their place. Federal Decree-Law 25/2025, the Civil Transactions Law, governs agency across the UAE at Articles 866 to 903, and it came into force on 1 June 2026. An agency may be general, special, conditional, or deferred to a future time. Those four are the only type names UAE statute uses.

Notarial duties may only be performed by public notaries, private notaries and accredited UAE consuls, under Article 3 of Federal Decree-Law 20/2022. Article 2 of the same law carves out local judicial authorities whose notarial services run under their own legislation. We have read no published Ajman notary text, so we will not tell you which side of that line your document sits on. Acceptance is decided by the body receiving the document, so we ask it first.

The two articles that decide what your agent can do

Most refused documents fail on wording, not on paperwork. Article 870 of the Civil Transactions Law requires a special agency, specifying the type of act, for anything that is not an act of management and preservation. It names donations, sale, settlement, mortgage, acknowledgment, arbitration, administering and accepting an oath, and pleading before the court. Article 871 completes the picture, and it is the line that catches people out.

What the Civil Transactions Law actually says

Article 870: any act that is not an act of management and preservation requires a special agency specifying the type of act and the dispositions it entails. Article 871: if the agency is expressed in general terms without specifying what is intended, it shall only grant the agent the power to perform acts of management.

Points we pin down before anything is translated

None of these come from Ajman practice. Every one of them comes from the agency articles that apply across the UAE, which is why we can state them plainly.

The notary verifies identity from an ID card or passport, checks capacity and consent, and reads the content out. We sit with you. The ratification is the notary’s act, never ours.

Errors that cost people a second appointment

The first list is what we see go wrong. The second is what we check before anyone books a slot or buys a ticket.

Why will you not publish the Ajman procedure on this page?

Because we have read no published Ajman notary text, and a guessed office, form or opening time costs you a wasted trip. Federal Decree-Law 20/2022 applies across the State but excludes local judicial authorities that run their own notary legislation. We confirm which requirement applies with the body that will receive your document, before anything is drafted or booked.

My power of attorney says the agent may act generally. Is that enough?

Probably not. Article 871 of the Civil Transactions Law says an agency expressed in general terms, without specifying what is intended, grants only acts of management. Article 870 requires a special agency naming the type of act for anything beyond management and preservation, and it names sale, mortgage, settlement, arbitration and pleading before the court among them.

Who is allowed to translate it, and what if I do not speak Arabic?

The Arabic is prepared by a legal translator registered with the Ministry of Justice. Language at the appointment is a separate thing: Article 8(3) of Federal Decree-Law 20/2022 says that if the notary is unfamiliar with your language, an interpreter listed in the Ministry’s Interpreter Register is engaged, in your presence. The federal schedule prices notarising a translation inside an instrument at AED 50 per page.

Does an apostille from my home country work here?

No. The UAE is not a contracting party to the Hague Apostille Convention, so there is no apostille route in. A document signed abroad goes through the foreign ministry of the issuing country, then the UAE embassy or consulate there, then MOFAIC in the UAE. MOFAIC publishes AED 150 for individual affairs documents and AED 2,000 for commercial ones.

How much will an Ajman power of attorney cost?

We will not print a figure for Ajman. The fee is set by the authority that ratifies the document, and we have no published Ajman schedule to quote. The federal schedule, Cabinet Resolution 19/2024, prices a general or special power of attorney at AED 100 per party, and AED 130 through a private notary. The law behind it excludes local judicial authorities with their own notary legislation.

Is there an online route for a power of attorney?

There is a federal one. The Ministry of Justice operates the E-Notary System, and a digital power of attorney service that produces a digitally ratified document without a visit to a notary office. Federal Decree-Law 20/2022 sets personal appearance as the default in Article 17, then allows the notary to use IT tools instead in Article 18. Whether either covers your Ajman document is something we check.

What brings a power of attorney to an end?

Article 897 of the Civil Transactions Law lists the events: completion of the work entrusted to the agent, expiry of the term specified in the agency, and the death or loss of legal capacity of either the principal or the agent. There is no general statutory period in UAE law. The term is whatever the document states.

Why does telling the agent about a revocation matter?

Article 898 lets the principal revoke or restrict the agent’s authority at any time, unless the agency involves a third party’s right or was issued in the agent’s interest. Article 902 explains why notice matters: a litigation agent who acts after learning of their dismissal is liable, while acts done before they knew remain effective. Revoking a principal agency revokes the sub-agencies under it.
